The initiatives undertaken in recent years by some Regions, aimed at obtaining greater autonomy, have brought attention back to the theme of the so-called “differentiated regionalism” pursuant to article 116, paragraph 3, of the Constitution. In the absence of a legislative framework for the implementation of this constitutional provision, one of the main issues to be resolved is the identification of the procedure to be followed to give greater autonomy to ordinary Regions. In particular, the essay will focus on possible ways of involving Parliament in defining the agreement between the State and the Region, in order to ensure adequate participation of the legislative Assemblies in the process of implementing the differentiated regionalism.
Le iniziative intraprese negli ultimi anni da alcune Regioni, volte ad ottenere “ulteriori forme e condizioni particolari di autonomia”, hanno riportato l’attenzione sul tema del c.d. regionalismo differenziato ai sensi dell’art. 116, comma 3, Cost. In assenza di una disciplina legislativa di attuazione di tale disposizione costituzionale, uno dei principali nodi da sciogliere è costituito dall’individuazione del procedimento da seguire per attribuire maggiore autonomia alle Regioni ordinarie. In particolare, si concentrerà l’attenzione sulle possibili modalità di coinvolgimento del Parlamento nella definizione dell’intesa tra lo Stato e la Regione, al fine di assicurare una adeguata partecipazione delle Assemblee legislative al processo di attuazione del regionalismo differenziato.
