Libertà di cronaca e libertà di critica nell’era di internet: qualche riflessione

Technological innovation and the emergence of the internet and social networks have radically transformed the way we seek, receive, produce, and distribute information, creating formidable opportunities but also giving rise to new risks and problems. These problems concern, among other things, the need to protect some fundamental individual rights, such as the rights to honour, reputation and privacy, or the right to be properly informed. It is therefore necessary to understand how to adequately balance the constitutionally relevant interests and assets in conflict with each other without limiting the fundamental freedom of expression.

L’innovazione tecnologica e la comparsa di internet e dei social network hanno trasformato radicalmente il modo di cercare, ricevere, produrre e distribuire le informazioni, creando delle formidabili opportunità ma anche facendo sorgere rischi e problemi nuovi, che attengono, tra l’altro, alla necessità di tutelare alcuni fondamentali diritti individuali, come i diritti all’onore, alla reputazione e alla riservatezza, o il diritto ad essere correttamente informati. Occorre allora capire come bilanciare adeguatamente gli interessi e i beni di rango costituzionale in conflitto tra loro senza limitare la fondamentale libertà di espressione.
