The Author proposes a legal analysis of the dispute arisen between club Napoli and Mr Luciano Spalletti, following the coach’s decision to enter into a new employment contract with the FIGC. In the initial part of the essay, the Author concludes for the legitimacy of the prohibition of non–competition agreements in sport. Thereafter, he debated over the interpretation of the clause in the settlement agreement that provides for the payment of a sum in the event of a new employment for a team, as a condition precedent resulting in the termination of the agreement.
L’Autore propone una lettura, dalla prospettiva giuridica, della controversia tra il club Napoli e Luciano Spalletti, in seguito alla decisione di quest’ultimo di sottoscrivere il contratto con la FIGC. Dopo aver escluso la violazione del divieto di stipulare patti di non concorrenza nello sport, si propone, in chiave dubitativa, la ricostruzione della clausola dell’accordo transattivo che prevede il pagamento di una somma in caso di passaggio a una diversa squadra alla stregua di una condizione risolutiva.
