The article examines the legal value of guidelines in medical liability trials after the recent legislation in Italy (recent law 189/2012, the so called “Balduzzi Law”). Legal debate and case law cope with the potential binding effect of the guidelines underlining that they could not have an uncontested legal binding effects, neither after the art. 3 of law 158/2012 come into force.
