The Supreme Court’s judgement deals with the issue relating to the definition of damage (art. 318-bis d.lg. n. 152 of 2006), as a condition that doesn’t allow access to the environmental extinction procedure. The aim of this work is to provide a systematic interpretation allowing access to the environmental extinguishing procedure not only to facts which haven’t caused any damage or danger to the environment, but also to those causative facts of minor damage or danger, assessing such requirements on the offensive/ not punishable level.
Nella sentenza in commento la suprema Corte affronta alcune problematiche legate alla nuova disciplina estintiva delle contravvenzioni ambientali (introdotta dalla l. n. 68 del 2015) agli artt. 318-bis - 318-octies nella parte VI bis d.lg. n. 152 del 2006 (recante «Disciplina sanzionatoria degli illeciti amministrativi e penali in materia di tutela ambientale»).
