The present paper is concerned with an initial analysis of the regulatory provision of Article 26(1) of Decree-Law No. 48 of 2023, converted into law n. 85 of 2023, which reformed and simplified the manner in which workers are to be informed about their conditions of employment. After an initial analysis of the provision, the contribution explores some of the application aspects of the provision, with a focus about how to refer to the collective agreement. The analysis concludes with some reflections on the (in)operability of the new provision about the case in which the employer doesn’t apply any collective agreement and about the case in which the law imperatively requires its application.
Il contributo ha per oggetto una prima analisi della previsione normativa di cui all’art. 26, comma 1 del d.l. n. 48 del 2023, convertito successivamente in l. n. 85 del 2023, il quale ha riformato e semplificato le modalità attraverso le quali informare i lavoratori e le lavoratrici circa le condizioni di impiego. Dopo una prima analisi della disposizione, il contributo ne approfondisce alcuni aspetti applicativi, a partire dal come disporre il rinvio al contratto collettivo. L’analisi si conclude con alcune riflessioni circa l’(in)operatività della nuova disposizione rispetto al datore di lavoro che non applica alcun contratto collettivo e rispetto ai casi in cui, invece, è la legge inderogabilmente ad imporne l’applicazione.
